Pursuant to a letter agreement dated February 16, 2010 with the Communication Workers of American, Local 9511, AFL-CIO, hereinafter referred to as "Local 9511," and a letter agreement dated February 26, 2010 with the Communication Workers of American, Local 9509, AFL-CIO, hereinafter referred to as "Local 9509," and the American Arbitration Association hereinafter referred to as the "Administrator," agreed to conduct a merger election.

Two thousand five hundred and eighty-eight (2,588) ballots were mailed to eligible voters on Thursday, February 11, 2010.

Local 9509 and Local 9511 provided the Administrator with a list of persons who were eligible to vote.

To be counted, ballots had to be received by the Administrator no later than 9:00 a.m., Thursday, March 04, 2010. A total of six hundred and forty (640) envelopes were received by the Administrator. One hundred and thirty-one (131) Local 9511 envelopes were received by the Administrator, of which one (1) was not counted. Five Hundred and nine (509) Local 9509 envelopes were received by the Administrator, all were counted. There was one uncounted, unmarked envelope not counted.

The counting of the ballots took place at 10:00 a.m. on Thursday, March 04, 2010 at the offices of the AAA, 600 B Street, Suite 1450, San Diego, California. The returned ballot packets were checked off against an eligibility list. The ballots were then extracted from the packets and tabulated in the presence of the election committee and observers.
